the boy Is injured and cant play a full season = you lose

Actually, quite a bit of money is involved.

Due to our respective popularity levels on our respective home sites, Ro and I receive substantial payments for the rental of our signature space. The loser of the bet will lose a valuable commodity for the duration of the mandated conciliation sig.

Right now, I'm being paid by Nike not to have a sig. I can't disclose the price or the reason, but trust me, its a tidy sum.

Then by your own argument, we could just as easily assume what was left unsaid benefits me, not him. After all, it was a bet for the season. A season is 16 games long. Go ahead, prove the definition of an NFL season wrong. We never made a bet that said it was for the first six-and-a-half games.

Also, Avenger is right. Microsoft pays for my sig space. The ad is subtle, but it's there. This is going to cost me deep into six figures.

    Re: Sig bet

As I recall, the bet was based upon a prediction of what Sam's rating would be "at the end of the season." As HUbison said, I'm pretty sure that's going to be 90.9.

I'd argue in court that since Bradford never played until the end of the season, it's invalid.

    And you'd lose that argument.

There is no ambiguity in the "contract." Consequently, it must be given its plain meaning. You cannot imply a term that is not present, nor can you bring extraneous matters into the analysis. It comes down to the "four corners of the agreement."

You should have just taken the crepes compromise.

Incorrect, sir. The point is that I am specifically NOT arguing what is not there. With nothing changing at the end of the season Bradford's rating will still be 90.9. This is NOT about assumptions, it's ONLY about what is actually there.

But now, since contracts aren't my specialty, I'm going to go back to sending people to prison.

Psh, your typical lawyer's attempt at confusing the jury to get the verdict you want doesn't work on me.

    Re: Sig bet

I'm sorry, but if there wasn't something stating that an injury voided the bet, then the bet stands. As far as your pro Bradford comment, let me recommend a quote from Jeff Fisher:

"The knee itself is in really good shape, with the exception of the ACL." It seems like a positive quote to me.

    Re: Sig bet

The bet should be called off because neither side will ever know what his passer rating would be at the end of the year due to his injury.
